PURCHASE OF PRODUCTS

After placing an order enquiry, you will receive an email from us. This email is an Order Confirmation

to notify you of the fact we have received and accepted/declined your order.

If your order is confirmed, we will attach an invoice.

 

If you wish to add to or change your order, or change the date or time of delivery or collection
of your order, then we will accommodate you, subject to kitchen space being available to permit us
to make your products, provided that you notify us via email at hello@thebakelist.com by 12.00
noon the day before your order is due to be collected or delivered.

 

PRICE AND PAYMENT

 

Our site contains a large number of Products and it is always possible that, despite our
best efforts, some of the Products listed on our Site may be incorrectly priced.
If a Product's correct price is higher than the price stated on our website/invoice,
or we are no longer able to supply a particular Product for some reason, we will
contact you by email to advise you and/or to obtain your confirmation that
the amended price is acceptable.

 

Payment for all Products must be by credit or debit card and those accepted by us
are those listed on our website on the date when your order is placed. We will send
you an invoice upon receipt of payment.

 

If the issuer of your payment card refuses or for any reason does not, authorise payment
to us, whether in advance of or subsequent to a payment, we will not be liable for any delay
or non-delivery of the Products ordered.

 

AVAILABILITY, DELIVERY AND COLLECTION

 

To avoid disappointment booking as far in advance as possible is advised as our handmade
products require time to prepare.

If for any reason no one is present to receive delivery of the Products at the delivery address
you have provided, we will call you to either confirm if you would like the product left
in a safe place or with a neighbour or we will take the Products back and retain the product
for 24 hours during which time you may contact us at hello@thebakelist.com to either
arrange for personal collection or redelivery the following day, although this is subject
to availability.

 

If for any reason you find yourself unable to collect your order from the designated shop
within the given time slot, we will retain your ordered Products for collection by you
for 24 hours.

RISK AND TITLE

​

The Products will be at your risk from the time you collect the Products from our shop or when we deliver them to you.

​

Ownership of the Products will only pass to you when we receive full payment of all sums due for them,
including delivery charges.

​

RETURNS POLICY

 

If upon collection or delivery of the Products you find that they are not those ordered by you (for example, the colour
or wording is incorrect), or the order is incomplete, or a Product is in a damaged condition when you receive it,
please notify us immediately via email at hello@thebakelist.com.

 

If a Product is not as on the Order Confirmation or damaged we will credit or refund your purchase.
In the case of damaged goods you must retain the damaged Products and all packaging for inspection by us.
Subject to our report on the claimed damage and to these Terms and Conditions we will refund the price you paid
for the returned Products together with the delivery charge, or at our option we will provide you with a credit for further products. We will have no liability to you for any indirect loss. Please state clearly your dispatch details in all communications to us.

 

Since taste is a very personal matter and subjective we cannot accept the return of any Products merely because you
do not like the taste.

 

We have made every effort to display as accurately as possible the colours of our products that appear on our Site
and also to ensure that the colours on screen are as close as possible to the colours of the actual product. However,
the colour of the actual product you see on your screen will depend on your monitor, its screen settings and resolution. Accordingly, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery and we cannot accept the return of any product because it does not match the colour you were expecting from viewing your screen display.

PHOTOGRAPHS AND MARKETING

We respect the privacy of all our clients. We will not disclose the identity of clients (photographs of people, last names, event details, contract details) without permission. We do however, reserve the right to photograph baked goods and use those photos on our website, social media, or marketing materials. We also reserve the right to use any photographs for display or promotion without compensation to you.

 

PRODUCT DISCLAIMER

 

The Products ordered are fresh on the day of delivery to or collection by you and will remain fresh for a further 24 hours from the time of delivery or collection if kept by you at an ambient temperature in the box provided. Products placed
in a fridge or a freezer or kept for a time longer than 24 hours are so kept at your own risk and we are not liable for any deterioration of the Products in these circumstances.

We want to help our customers make informed choices about our products.

 

If you are adhering to a special diet, or you have intolerances or allergies please review our ALLERGEN DISCLAIMER & INGREDIENTS LIST below:

 

Every effort has been made to keep this information current, however, changes or substitutions may occur.
Please be advised that all of our foods are prepared in a common kitchen - we do not have segregated production lines, so there is risk of cross-contact.

 

Our kitchen handles all the main allergens of dairy, nuts, peanuts, gluten (wheat), egg, sesame, sulphites and soya.
If you have a serious allergy to any of these allergens, or one that can cause you to have a major allergic reaction,
then we do not recommend you consume any of our products.

 

Made-Without-Gluten Recipes

Our gluten-free offerings are designed for those with minor gluten sensitivities or those who prefer to avoid gluten
for nutritional reasons. We do not recommend our products for people with Celiac Disease.

 

Nuts

Our nut free recipes are produced in the same area where products containing various nut items are created.
We do not recommend our products for people with severe nut allergies.

We use the information we collect to:

  • administer our site and improve your browsing experience, including tailoring content offered to you;

  • defend our rights or property and to protect the rights and interests of our consumers and users; and

We do so for the purposes of crime prevention, and in a way which is consistent with guidance issued by the Information Commissioner’s Office. All telephone records will be deleted from our records 6 months after the date of the relevant

conversation. We reserve the right to share telephone records with law enforcement agencies, and we may also use those records for training purposes, but will otherwise keep them strictly confidential.

We may share your personal information with our affiliated companies and with trusted, strategic partners that help us run our business and improve our services and your customer experience, including matters such as warehousing and delivery, credit card and data processing, marketing and advertising, IT hosting and market research, and any trends, patterns or behaviours which might be useful to us in improving our website, content and advertising.  

In order to ensure the security of your transactions and prevent or detect fraudulent transactions, we may also share your information with our fraud screening partners. We won’t otherwise share your personal data unless we have your permission or are required by law to do so.
 
Be aware that our site includes social network plugins and links to third party content (including videos hosted by other sites), so certain data (your current IP address, e-mail address, pages or sites you visit after you leave our site and the date and time) is forwarded to these social media services and third party sites even if you are not registered with them. If you are already logged into the social media service when you click on the social media button, the social media service may also use this data to identify your user name and possibly even your real name. Unfortunately, we have no control over 
the extent, nature and purpose of such data processing or their privacy practices – we suggest you review their privacy statements to make sure you are comfortable with the way they use your information as well. 
 
You can rest assured that we’ll only disclose your information for the specific purposes mentioned above and that your data security is being taken care of. These third parties are bound to process your personal data only on our strict 
instructions and, even then, only when they can offer adequate technical and organisational measures to protect it. We may also disclose your personal information as necessary to protect the security and integrity of our site according 
with the law; in the event that we sell or transfer all or a portion of our business or assets to a third party; or as required or authorised by law. As part of our participation in Google’s Certified Shops Programme, certain information relating to transactions undertaken on our website will be collected and processed by Google. We provide transaction information 
to Google to demonstrate that we deliver orders on time, have low occurrence of customer issues, and resolve customer issues quickly. 
 
SHARING INFORMATION OVERSEAS

We may transfer your personal information to service providers and strategic partners located in countries other than the one in which you live (only to the extent that it is necessary to fulfil the purposes outlined above).

SECURITY OF YOUR PERSONAL INFORMATION

In addition to the commitment of our employees to secrecy and a careful selection and monitoring of our service providers, who are bound to comply with high security standards for the protection of your personal data, we also secure our operating environment adequately.To protect your data against unwanted access, we use data encryption. 
Data collected from this site will be passed between your computer and our server and vice versa via the internet using PCI compliant encryption (minimum TLS, Transport Layer Security, version 1.2). In order to secure the transmission of sensitive bank and credit card details from the moment you input this information on our site to our trusted payment processors, and to protect data from abusive use we utilise in transit encryption (SSL, Secure Socket Layer). Credit card data is not stored in our database or our systems.
 
YOUR RIGHTS

If you wish to exercise any of your statutory rights relating to data we hold about you, please get in touch here and we will be happy to help. Once we get all of the information we need to process your request, your request will be investigated by our Data Protection Officer. A response will then be provided in writing within a reasonable period (we will always try to ensure this is no longer than within one month, but we may inform you should we need more time to process your request 
in certain circumstances). We promise that we will follow procedures so that we can deal fairly and promptly with your request. However, if you remain dissatisfied after we have processed your request, you have the right to lodge 
a complaint with the Information Commissioner’s Office.

COVID-19 SAFE RULES


In keeping with the mandatory Queensland Government guidelines under the Roadmap to Recovery, there are a few new rules we all need to follow. If you're sick or have any COVID-19 symptoms, please stay home. 
Under the new regulations, we have the right to refuse service to anyone who appears unwell and by law we must ask you to leave. To sit at Bake List, it is now mandatory for business and patrons to use the Queensland Government’s Check In Qld App, you can check app information here.


The maximum number of customers we can legally have within footpath area is ##. 
If there are already ## seated in the footpath area, or if your group takes the total number above ##, you will have to wait. If we are full, please take advantage of our lifestyle for takeaway. 1.5 metre rule is still in play. Which means you are not allowed to share a table with a stranger. We have hand sanitiser for you, please use it.
